Release, Indemnification, and Liability Waiver: I hereby accept possession of, right to, title to, and responsibility for the Subject Animal identified below and hereby release and discharge Petey and Furends from any liability for any injury or damages to any person or property caused by the Subject Animal, and from any causes of action, claims, suits, or demands whatsoever that may arise as a result of such injury or damages, including instances involving the negligence of Petey and Furends. I agree to indemnify Petey and Furends from any such liability, causes of action, claims, suits, or demands. I also understand that my adoption fee is non-refundable.

No warranties: I understand that Petey and Furends makes no claims or, representations, or warranties (either express or implied) as to the temperament, health, or mental disposition of the Subject Animal. I acknowledge that animals differ from human beings in their responses to human actions, and such actions are often unpredictable; as such, I understand that the Subject Animal should be closely supervised when it is with children and other animals. I understand that the Subject Animal’s behavior may change after it leaves the shelter or foster home.

Indoor Companion Only: By adopting the Subject Animal, I agree that the Subject Animal will be kept only as a domesticated house pet. The Subject Animal will not be kept continuously in a yard, garage, patio, balcony, pen, or other outdoor space. The Subject Animal will not be used or trained as an attack or guard animal or sold or used for any purpose other than companionship. I agree that I will never allow any physical, mental, or emotional abuse of the Subject Animal. I agree that I will care for and supervise the Subject Animal in accordance with all applicable legal requirements.

Veterinary Care: I understand that Petey and Furends does not place any animal that it knows to be sick or injured, unless the condition is disclosed to the adopter. I am aware that the Subject Animal I am adopting comes from a shelter or foster home with limited resources and that Petey and Furends is under no obligation to provide a full medical exam prior to adoption. As a result, sickness, injury, and disability may exist in the Subject Animal unbeknownst to Petey and Furends. I agree to bring the Subject Animal to a veterinarian to complete a physical examination within 14 days of adoption, or, if no appointments are available in that period, as soon thereafter as reasonably possible. Petey and Furends is not responsible for payment of any veterinarian care, including for known and unknown medical conditions after I adopt the Subject Animal. If the Subject Animal is a young puppy that has not received their full rounds of vaccines, I will not take the Subject Animal to any public places (e.g., pet stores, dog parks, kennels, animal daycare establishments, etc.) and will not let the Subject Animal interact with any dogs other than any other dog that resides with me until a veterinarian has seen and cleared the Subject Animal for interaction. If a serious medical condition and/or injury is found that I cannot, or choose not to, have treated by a veterinarian, I must promptly (but in no event later than five days after the discovery of the medical condition and/or injury) contact Petey and Furends. I agree that that Petey and Furends has a right of first refusal to reclaim the Subject Animal, and that I cannot give away, sell, trade, or gift to a friend or family member, the Subject Animal unless and until Petey and Furends states that it declines to reclaim the Subject Animal. I will neither take the Subject Animal to a shelter nor abandon the Subject Animal nor release the Subject Animal into the wild. In the event that the Subject Animal is reclaimed, I hereby waive my right to any fees paid to Petey and Furends in connection with the subsequent adoption of the Subject Animal. In addition, for the duration of my ownership of the Subject Animal, I agree to provide all required routine veterinary care throughout the Subject Animal’s life and to provide prompt treatment by a licensed veterinarian for any illness or injury, unless or until a licensed veterinarian advises that the compassionate course is to euthanize the Subject Animal. I agree that the Subject Animal will be given monthly preventatives (heartworm and flea) every month, all year long.

Return Policy: I am adopting the Subject Animal for myself, and all my household members have agreed to my adoption of the Subject Animal and to treat the Subject Animal consistently with the terms of this Agreement. If for any reason I am unable to provide care to the Subject Animal (including through temporary arrangements for others to provide care to the Subject Animal if I am unavailable) or if I no longer wish to own the Subject Animal for any reasons, I agree to return the Subject Animal to Petey and Furends. I hereby give Petey and Furends a right of first refusal to reclaim the Subject Animal, and I will not give away, sell, trade, or gift to a friend or family member, the Subject Animal unless and until Petey and Furends states that it declines to reclaim the Subject Animal. I will not take the Subject Animal to a shelter nor abandon the Subject Animal nor release the Subject Animal into the wild. I understand that I must notify Petey and Furends, without unreasonable delay, if I can no longer care for or keep the Subject Animal on a long-term basis. Moreover, I understand that it can take up to two weeks for Petey and Furends to find a new home for the Subject Animal, and I will be financially responsible for boarding costs in the event I am not be able to keep the Subject Animal in my home. Additionally, prior to returning the Subject Animal, I will take the Subject Animal for a veterinary exam and/or a behavioral evaluation at my cost, upon request by Petey and Furends. In the event of such a return, I hereby waive my right to any fees paid to Petey and Furends in connection with my adoption of the Subject Animal.

Obedience Training: I agree to enroll the Subject Animal in obedience training by the date listed above and agree to send proof of obedience via postal service or email to Petey and Furends. I understand that obedience training is of utmost importance to help ease the Subject Animal’s transition into my home and to prevent the development of unwanted behavioral problems later on in the Subject Animal’s life. I understand that a minimum of four (4) group or individual classes and/or training sessions with the Subject Animal must be completed to meet this requirement. I understand that if I can no longer care for the Subject Animal due to behavioral issues, I will meet with a professional dog trainer and/or behaviorist and will provide evidence of the consultation, including but not limited to a report from such trainer or behaviorist, or I will be obligated to pay Petey and Furends for the consultation upon the return of the Subject Animal. In the event the animal is returned to Petey and Furends, I hereby waive my right to any fees paid to Petey and Furends in connection with my adoption of the Subject Animal.

History of Animal Cruelty: I warrant and represent that neither I nor anyone in my household have ever been subject to legal action for cruelty to and/or neglect of animals. I further warrant and represent that neither I nor anyone in my household have ever owned an animal that has been confiscated by any animal control or humane organization for violations of state or local animal control regulations or any animal adoption agreements.

Right to Reclaim: Petey and Furends reserves the right to reclaim the Subject Animal in the best interest of its welfare if the animal is neglected, mistreated, or denied medical care or I, the adopter, do not comply with this contract and/or fail to comply with local, county, or state laws regarding animal ownership.

Liquidated Damages: I understand that Petey and Furends has invested significant financial and personal resources into the care, treatment, and placement of the Subject Animal, and that the actual damages accruing to Petey and Furends in the event I fail to comply with the provisions of paragraphs 3, 4, 5, 6, or 7 would be difficult to prove with certainty. Accordingly, I agree that in the event of an intentional breach of paragraphs 3, 4, 5, 6, or 7, I will be required to pay liquidated damages to Petey and Furends in the amount of two thousand five hundred dollars ($2,500), not as a penalty, but as a reasonable estimate by the parties as to the damages resulting from a breach of the provisions of paragraphs 3, 4, 5, 6, or 7.

Choice of Law, Entire Agreement, and Modification: This Agreement shall be governed by and construed in accordance with Maryland law, and all actions will be resolved in the state of Maryland. The Agreement constitutes the sole Agreement between the parties and supersedes any and all prior understandings with respect hereto and is severable, so that if any portion hereof is deemed invalid, the remainder hereof shall remain in full force and effect. No modification of this Agreement will be valid unless in writing duly signed by you and Petey and Furends. This Agreement is binding upon you and your heirs, assigns, successors, personal representatives, and executors.

Exclusive Remedy: In the event of breach by Petey and Furends of any provision of this agreement, either through negligence or otherwise, my exclusive remedy is limited to the adoption fee paid to Petey and Furends in connection with the adoption of the Subject Animal. In no event will Petey and Furends be liable for any special, indirect, incidental, general, or consequential damages allegedly arising from or caused by Petey and Furends’ acts or omissions, under any legal basis, including contract, tort, or violation of statute.

I agree to have my dog enrolled in obedience training, as stated in paragraph 7 of the adoption contract, no later than the date listed above by an obedience trainer of my choosing. I understand that the requirement includes a minimum of four training sessions. I understand that no exceptions will be made.

I understand that there are mental, physical, and behavioral benefits to enrolling in obedience training. I have contacted trainers in my area and have confirmed that they are able and willing to enroll my pet into obedience training by the specified date.

I agree to provide proof of enrollment in obedience training within one week of beginning the course and understand that Petey and Furends, Inc., reserves the right to follow up should they not receive said proof.

I understand that by voluntarily signing this agreement, I am entering into a legal and binding contract with Petey and Furends. Breach of any term(s) of this agreement is deemed actionable by Petey and Furends. In the event that there is a violation of the agreement, I agree to pay a minimum of $2,500.00 in damages. Additionally, in order to facilitate the collection of damages for breach of contract, I waive any challenge to the venue and agree that the appropriate venue for this matter is the State of Maryland. Furthermore, I agree to accept service of process by certified mail, return receipt requested, to the address provided in this adoption contract, and specifically waive any right to receive personal service.
